Bermuda repealed marriage equality

Bermuda became the first jurisdiction to repeal same-sex marriage after legalizing it in 2017.

Bermuda's Governor John Rankin has signed the bill into law canceling the right to marry for same-sex couples.

The Supreme Court had legalized marriage equality in May 2017. But last December, the Senate and the House approved the bill to repeal same-sex marriage.

Bermuda’s minister of home affairs, Walton Brown, said the legislation would rebalance things on the island. Bermuda is a conservative territory. He believes that the opposition is satisfied while ensuring the recognition and protection of LGBT couples.

What a decline in civil rights! LGBT couples may be recognized with civil partnerships but this doesn't replace marriage.

“Governor Rankin and the Bermuda parliament have shamefully made Bermuda the first national territory in the world to repeal marriage equality,” said Ty Cobb, director of Human Rights Campaign Global.

The British government said it was "disappointed" by this decision. Bermuda is attached to the United Kingdom but remains an autonomous territory with its own laws. That's why the British government didn't intervene.

Harriett Baldwin, a UK foreign office minister, said: “The secretary of state decided that in these circumstances it would not be appropriate to use this power to block legislation, which can only be used where there is a legal or constitutional basis for doing so, and even only in exceptional circumstances.”

Will the decision be challenged? The lawyer who had obtained marriage equality before the Supreme Court said he might challenge the decision through a constitutional action.
