U.S. District Judge Juan Pérez-Giménez took the view that this legislation could not apply to "unincorporated territories" in the United States as Puerto Rico.
The judge is based on the fact that the decision of the Supreme Court, which wrote precisely in the text that this law applies to states and their courts. This is by no means clear that the Commonwealth territories are also included in the law.
So, the Puerto Rican judge believes that it is not up to him to make a choice on the issue of equal marriage, but rather than taking sides in favor of equal marriage, he decided to oppose it. Already in October 2014, the judge upheld the ban.
There will likely be an appeal following his decision.
