In May 2015, lawyer Jesus Falcis III, who is openly gay, filed a petition with the High Court to have marriage equality recognized. The petition was based on the 1987 Family Code and the 1949 Civil Code.
The Supreme Court has heard this request and is proposing a debate that will begin on June 19, 2018.
“The petition is one for certiorari and prohibition challenging certain provisions of the Family Code on marriage where they impact on ‘same-sex’ marriages,” High Court’s Information Chief Atty. Theodore Te said at a press conference.
Government lawyers oppose this petition, which they describe as “intrinsically flawed”.
"This is an invitation to a debate or coffee-shop conversation, not a constitutional litigation,” Solicitor General Florin Hilbay said.
The fact that the Supreme Court will held debates on marriage equality is a huge victory in the Philippines! It is a Muslim country. It's not easy for lesbian, gay, bisexual and transgender Filipinos to freely live their love.
