I already wrote about Valerie and Nathalie, a lesbian couple who have had a girl in 2000 with an artificial insemination in Belgium by Nathalie. Valerie thus logically wanted to be recognized as her mother but the French justice refused (adoption by gay and lesbian couples being not possible in France).
They have then asked the European Court hoping for a different decision but the Court has also refused the adoption considering that French justice was right. For the judges, the decision is not "based on sexual orientation". For gay and lesbian couples and for straight couples in a domestic partnership, adoption is not possible.
Of course, as the lawyer of the couple, Caroline Mécary, said, "the child is on a legal level less protected than if she was raised by a straight couple. It is also a terrible consternation for the children who are raised by gay couples, which remain discriminated because they have one relative and thus are less protected than the children of straights, which them have legally two parents. That has consequences, no transmission of the name and the inheritance."
This could change in a few weeks with the presidential elections.
