U.S. District Judge Joseph Bataillon told the clerks they could begin issuing same-sex marriage licenses on March 9.
«[A]ll relevant state officials are ordered to treat same-sex couples the same as different sex couples in the context of processing a marriage license or determining the rights, protections, obligations or benefits of marriage,» he wrote in the order.
The Attorney General Doug Peterson immediately said he would appeal the judge's decision before the 8th Circuit Court of Appeals.
The judge Battalion had repealed the ban in 2005 but the Court of Appeals reversed his decision in 2006. Hopefully this won't happen again.
