Three judges have been chosen: Stephen Reinhardt, Michael Daly Hawkins, and N. Randy Smith.
Judge Stephen Reinhardt (on the left) is a liberal. He supported a gay couple by ordering the federal government to pay the health benefits that it refused to give.
Judge Michael Daly Hawkins (in the middle) is more a moderate. He was part of the judges who recently asked that the Judge Vaughn Walker keep his position. Judge Walker who stayed and return the marriage equality law in August.
Accorded to the Mercury News, "legal experts say Reinhardt and Hawkins may be receptive to the argument that the state's gay marriage ban violates the federal equal protection rights of same-sex couples. But they also cautionagainst being overly reliant on ideology to forecast the case because the 9th Circuit may not even deal with that central question."
"As a result, it is less clear to 9th Circuit experts how a judge such as Reinhardt or Hawkins might address that issue."
Finally, Judge N. Randy Smith (on the right) is a former chairman of Idaho's Republican Party nominated in 2007 by President George W. Bush and joined the court in the same year.
