Three times that the group is trying to get the right to defend the ban in Oregon when it has no legal status to do so. Each time, a court rejected its request.
The court stated:
"The full court has been advised of the petition for rehearing en banc and the Declaration of Roger K. Harris in support. No judge has requested a vote on whether to rehear the matter en banc. See Fed. R. App. P. 35; 9th Cir. Gen. Ord. 6.11. Appellant the National Organization for Marriage’s petition for rehearing en banc is denied."
NOM however can still appeal to the Supreme Court of the United States but that request will probably be also rejected. The Supreme Court had rejected a similar request in the "Proposition 8" case.
