Two Mothers Won The Right To Both List Their Name On Their Daughter's Birth Certificate In Iowa

Victory for the Gartners who obtained the right to list the names of two women as biological parents on the birth certificate of their daughter.


Heather and Melissa had decided to sue the Department of Public Health in Iowa after only the name of Heather was written on the birth certificate of their child even if they were married in the state (Iowa legalized marriage equality in 2009).


Officials of the department indicated that the second mother had to adopt the child to be then recognized.


Despite everything, Heather and Melissa won their lawsuit arguing in particular on the fact that this approach had deprived the child of protections and benefits of having two legal parents.


"It is important for our laws to recognize that married lesbian couples who have children enjoy the same benefits and burdens as married opposite-sex couples who have children," Judge David Wiggins said.
